NEC means NEC Computers Australia Pty
Limited ACN 073 837 859.
Promotion means the Cash Back promotion run by
NEC in accordance with these terms and
conditions.
Promotional Period means 1st August 2008 to 24th December 2008.
Tax Invoice means a tax invoice issued to you
when you purchase an Eligible Product during the
Promotional Period.
Eligibility Criteria
1. This Cash Back offer is only open to you if
you are an Australian resident (individuals or
companies). You will not be eligible for this
Cash Back Offer if you are an employee or
immediate family member of:
(1) NEC;
(2) A participating NEC outlet;
(3) An NEC Reseller; and
(4) Any other agency connected with the sale of
NEC products.
2. To be eligible for the Cash Back, you must
purchase an Eligible Product during the
Promotional Period from an Eligible NEC Reseller
and have paid for the Eligible Product in full.
3. One Cash Back may be redeemed per Eligible
Product purchased.
4. This Cash Back offer is not valid when used
in conjunction with any other special, discount
or promotion unless indicated otherwise.
5. Claims in relation to back-ordered products
or products which have been returned will not be
accepted.
What procedures must be followed to make a
claim?
6. To make a claim, you must do the following:
(1) Download and complete the official claim
form by visiting
http://www.nec-computers.com.au/cashback
(2) Send a print out of the completed claim form
together with a photocopy of your original Tax
Invoice verifying your purchase of the Eligible
Product during the Promotional Period and that
you have paid for the Eligible Product in full
to “NEC Cash Back Offer” PO Box 210 Rosebery NSW
1445.
(3) Further enquiry can be made on 02 9313 0007.
7. NEC will not accept illegible Tax Invoices,
handwritten Tax Invoices, delivery dockets or
part payment receipts.
8. In order for a claim to be valid, NEC must receive
your claim by 5pm EST on Friday January 17th 2009.
Any claims NEC receives after this time will not be processed.
You will forfeit your right to make a claim if NEC
does not receive your claim by this time. It is your
responsibility to ensure that NEC receives your claim by this time.
9. NEC does not accept responsibility for any
late, lost or misdirected mail. To avoid
disappointment, NEC recommends that you send all
claims via registered post and retain a copy of
all documents sent for your own records.
How will the Cash Back Offer be paid?
10. When NEC receives your Claim Form and Tax
Invoice, NEC will review your claim and the
documents to ensure that it complies with these
Terms and Conditions.
11. If your claim is approved by NEC, the Cash
Back will be paid by a cheque in accordance with
the details specified on the Claim Form. NEC
accepts no responsibility for delays or claims
that have not been paid because you have
supplied NEC with incorrect banking details.
12. Please allow up to 75 days from the date of
receiving and validating your claim for the Cash
Back to be paid.
13. If your claim is not approved by NEC because
your claim does not meet these Terms and
Conditions, the claim will be invalid. NEC will
advise you of the reason why your claim was not
approved and will allow you 14 days to respond.
In such a case, NEC may in its absolute
discretion accept or reject your claim.
Liability
14. NEC is not liable for any loss or damage
whatsoever which is suffered by any party,
including without limitation, indirect or
consequential loss or for a personal injury
suffered or sustained, as a result of this
Promotion, except for any liability which cannot
be excluded by law.
15. NEC is not responsible for any tax liability
which may arise because the Cash Back is
provided to you or another party.
Miscellaneous
16. Information on how to claim the Cash Back
forms part of these terms and conditions.
17. The Cash Back and these terms and conditions
are not assignable or transferable.
18. All decisions made by NEC in relation to
this Promotion are final and binding. NEC will
not enter into any correspondence with you,
except as otherwise stated in these terms and
conditions and will not enter into any
correspondence 7 weeks after the closing date of
the promotion.
19. NEC reserves the right to extend the closing
date of the promotion.
20. NEC reserves the right to verify the
validity of all claims submitted and to
disqualify any claim made which is not in
accordance with these terms and conditions in
its absolute discretion.
21. NEC collects your personal information for
the purposes of conducting the Promotion and you
consent to NEC using this information for this
purpose. If you do not provide the relevant
information, you will not be able to participate
in the Promotion.
22. The law of New South Wales governs this
Agreement. You agree to submit to the
non-exclusive jurisdiction of the courts of New
South Wales or any competent Federal court
exercising jurisdiction in New South Wales.
23. NEC is the promoter. |
